North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to vehicular traffic hazards: a)job site - flagmen were not located far enough in advance of approaching vehicles to provide sufficient stopping distance prior to entering work site. The posted speed limit was 45 mph. ABATEMENT NOTE: 1)Among other methods, one feasible and acceptable abatement method to correct these hazards is to: a)The employer can station flagmen at a distance of 220 feet in advance of work area to prevent entry of approaching vehicles into the work area. Reference:Hazards recognized and addresses in the Manual on Uniform Traffic Control Devices (MUTCD), millennium edition, December 2000, Section 6E.05, which states that flagger stations shall be located far enough in advance of the work space so that approaching road users will have sufficient distance to stop before entering the work space. Table 6E-1, indicates 220 feet for a 45 mph road.
