Nevada Revised Statute 618.375(1): Duties of employers. Every employer shall fur
nish employment and a place of employment which are free from recognized hazards
that are causing or are likely to cause death or serious physical harm to his o
r her employees. At Never Late Printing, LLC, located at 5010 South Decator Boul
evard, Suite A, the employer did not furnish a place of employment which is free
from recognized hazards that are causing or likely to cause death or serious ph
ysical harm to his employees. Employees were exposed to falls of approximately 5
to 6 feet to the floor below while storing materials in the upper story. The em
ployees were climbing on the top step and/or top plate of an aluminum 6-foot Dav
idson 527-006 stepladder in order to reach the upper story approximately 9 feet
in height. One feasible and acceptable means of abatement is to use a ladder of
sufficient
height which does not require employees to step or stand on the top cap or top s
tep of a step ladder, thus following the requirements of ANSI A-14.5-(2000), Sec
tion 9.3.2(1). Reference: American National Standards Institute (ANSI): ANSI A-1
4.5-(2000), Section 9.3.2 states: "The user shall climb or work with the body ne
ar the middle of the step or rung. The user shall not step or stand higher than
the step or rung indicated on the label marking the highest standing level of a
ladder. The user shall not step or stand on: (1)A ladder top cap and top step of
a step or trestle ladder, or the bucket or pail shelf of a self supporting ladd
er."
