North Carolina General Statute, 95-129(1), of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish employment and a place of
employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to carbon monoxide levels
above the permissible
exposure limit:
a)facility - employees were exposed to levels of carbon monoxide above the
permissible exposure limit (PEL) on January 3, 2014.  The Greensboro Fire
Department reported monitoring carbon monoxide levels of 300 to 400 ppm on
the evening of January 3, 2014. Eighteen employees complained of symptoms
including but not limited to headaches, nausea, vomiting, rapid heartbeat,
and
dizziness and were seen / treated by Guilford Co. EMS and Moses Cone ER
over
two days for carbon monoxide exposure. On December 3, 2013 the HVAC
contractor, STR Mechanical, conducted an inspection of the HVAC equipment
and found / reported to O'Charley's #908 that the Trane M#YCD102C3HOAC
/ S#NS1100616D had a hole in the heat exchanger. The employer continued to
operate the place of employment knowing the heat exchanger, a source of
carbon
monoxide, had a hole in it.
ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement
method to correct this hazard would be to incorporate / install carbon
monoxide detectors
throughout the restaurant to warn of increasing levels of carbon monoxide
and prevent
overexposure situations.e
