29 CFR 1926.453(b)(2)(v): A body belt was not worn and a lanyard attached to the boom or basket when working from anaerial lift.Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable aspart of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under1926.502(e). On or about May 31, 2011 an employee was working from an aerial lift performing carpentry work without fall protection exposing the employee to a fall hazard of 18 feet.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and verticalsurface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrailsystems, safety net systems, or personal fall arrest systems. On or about May 31, 2011 an employee was working from a roof performing carpentry work without fall protection exposing the employee to a fall hazard of 22.6 feet.
