29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever was less, were not equipped with one stairrail system along each unprotected side or edge:         a)  JC Valencia Construction In. at 10024 East Fairplay Street, Commerce City, CO 80022:  On or before June 4, 2011, the employer did not ensure that the following stairs had stairrails on the unprotected side:               1)  The stairs from the main floor to the second floor had 7 steps that were 38" wide, with a 7.5" rise and an 11" run, with an open side. Condition exposed employees to a fall hazard of 58"; and              2)  The stairs from the main floor to the basement had 11 steps that were 38" wide, with a 7.5" rise and an 11" run, with an open side.  Condition exposed employees to a fall hazard of 7'.    Abatement Note:  Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter").

29 CFR 1926.404(f)(6): Grounding path:  The path to ground from circuits, equipment, and enclosures was not permanent and continuous.         a)  JC Valencia Construction In. at 10024 East Fairplay Street, Commerce City, CO 80022:  On or before June 4, 2011, the employer did not ensure that the orange extension cord used to power a 15" circular Skilsaw on the main floor was grounded.  The Skilsaw was not double insulated, but the cord was used with a ground fault circuit interrupter.  Condition exposed employees to electrical shock hazards.      Abatement Note:  Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter").

29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet(1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provided an alternative fall protection measure:         a)  JC Valencia Construction In. at 10024 East Fairplay Street, Commerce City, CO 80022:  On or before June 4, 2011, the employer did not ensure that the employees were protected from falling into the stairway hole from the second floor to the main floor, where the studs were 24" apart.  Condition exposed employees to a fall hazard of 8'.    Abatement Note:  Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter").
