29 CFR 1926.200(g)(2):  The employer did not ensure that all traffic control signs or devices used for protection of construction workers conformed to Part VI of the Manual of Uniform Traffic Control Devices (MUTCD) Millennium Edition, December 2000:    a)  North Forest Office Space, LLC at 13659 E. 104th Ave., Commerce City, CO 80022:  On or before June 4, 2011, the ccreating, correcting, and controlling employer had closed the right lane of Potomac Street, and did not provide any advanced warning signs of this lane closure.  Subcontractor employees were pouring and trawling new cement for the curb and gutter.  Condition exposed these employees to struck-by hazards.    Abatement note:  Abatement certification is required for this item (see enclosed ,"Sample Abatement-Certification Letter").    Abatement note:  The MUTCD Section 6B.01 provides that the control of road users through a temporary traffic control zone shall be an essential part of highway construction, utility work, maintenance operations, and incident management.  Sections 6C.03 and 6C.04 discuss the requirements associated with advanced warning areas, providing that the advanced warning area is that section of the road where users are informed about the upcoming work zone or incident area.  Typical Applications 18 illustrates a Lane Closure for a Minor Street, applicable to these circumstances.

29 CFR 1926.202:  The employer did not ensure that all barricades for protection of construction workers conformed to Part VI of the Manual of Uniform Traffic Control Devices (MUTCD) Millenium Edition, December 2000:    a)  North Forest Office Space at 13659 E. 104th Ave., Commerce City, CO 80022:  On or before June 4, 2011, the creating, correcting, and controlling employer did not ensure that the barricades conformed with the MUTCD in that no taper was set up to direct traffic away from the work zone, no cones were in place along the tangent of the work zone (between the lanes of Southbound Potomac Street), and no cones were in place after the work zone to direct traffic back into the lane.  Subcontractor employees were pouring and trawling new cement for the curb and gutter.  Condition exposed these employees to struck-by hazards.    Abatement note:  Abatement certification is required for this item (see enclosed ,"Sample Abatement-Certification Letter").    Abatement note:   The MUTCD Section 6C.08 discusses the requirements associated with temporary traffic control zones, including the use of tapers with channelizing devices to move traffic out of or into normal paths.  Section 6F.55 describes the use of cones and other barricades to serve as channelizing devices.  Typical Application 18 illustrates a Lane Closure for a Minor Street, applicable to this work zone.
