OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees are exposed to an amputation hazard while using an unguarded foot pedal to actuate the Wysong shear:    a.) Deyco, Inc. located at 465 Spring St. Upper Sandusky, OH 43351; On or about July 12, 2011, the employer did not assure that employees were protected from amputation hazards while using the Wysong shear (Model #1025, serial # P37-372) to cut small metal pieces. The unguarded foot petal exposed employees to amputation hazards from accidental actuation while the point of operation guard was removed.    A feasible abatement method to correct this hazard is to comply with the requirements of ANSI B11.4-2003 Safety Requirements for Shears E6.3, Section 6.3.3.3 Actuating Means.
