29 CFR 1926.501(b)(13):     "Residential construction." Each employee engaged in residential construction activities 6 feet(1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provisionin paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it isinfeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets therequirements of paragraph (k) of 1926.502.Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fallprotection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complieswith 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.    On or about 07/01/11 during the re-shingling of a residential home, the employer did not ensure employees were protected from a fall of approximately 17 feet by using fall protection systems/devices.      On or about 07/01/11 during the re-shingling of a residential home/garage, the employer did not ensure employees were protected from a fall of approximately 6.6 feet by using fall protection systems/devices. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD 29 CFR 1925.501(B)(13), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 311496004, CITATION NUMBER 01, ITEM NUMBER 001 AND WAS AFFIRMED AS A FINAL ORDER ON 05/28/08/, WITH RESPECT TO A WORKPLACE LOCATED AT 36500 EUCLID AVE. WILLOUGHBY, OHIO 44094.    ARDIS ROOFING LLC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.501(B)(10), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 311159735 CITATION  NUMBER 01, ITEM NUMBER 05, AND WAS AFFIRMED AS A FINAL ORDER ON 01/23/08, WITH RESPECT TO A WORKPLACE LOCATED AT 4765 E. 355TH ST. wILLOUGHBY, OHIO 44094.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed inorder to minimize these hazards.
