29 CFR 1926.95(a): "Application." Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. On or about August 11, 2011, the company did not provide personal protective equipment including gloves and safety glasses for employees involved in the painting of a buildings exterior walls and trim. Employees work with hazardous materials such as Glidden Premium Exterior Latex Semi-Gloss Paint.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section will be met: A comprehensive hazard communication program needs to include the following required elements a written program specific to the company, material safety data sheets, a hazardous chemical inventory list, labelling of all containers, and documented "employee" training. On or about August 11, 2011, the company did not implement and maintain a written hazard communication program at the site. Employees work activities included but were not limited to painting of buildings wall and trim. Employees work with hazardous materials such as Glidden Premium Exterior Latex Semi-Gloss Paint.
