29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:    a)  On or about August 12, 2011, employees were not protected from injury in that, a ladder, ramp or other safe means of egress was not used while employees were working in a trench deeper that 4 feet in depth.    Perkins Excavating, LLC was previously cited for a violation of this Occupational Safety and Health Standard, or its equivalent 29 CFR 1926.652(c)(2) which was contained in OSHA inspection 311909980 Citation 1, Item 1 issued on February 5, 2009 and became a final order on March 8, 2009 with respect to a worksite located at 2807 Champa St., Denver, CO 80204.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c):    a)  On or about August 12, 2011, employees were exposed to cave-in hazards while working in a trench that did not contain an adequate protective system.  Portions of the trench where employees were working were deeper than 5 feet and contained vertical walls.    Perkins Excavating, LLC was previously cited for a violation of this Occupational Safety and Health Standard, or its equivalent 29 CFR 1926.652(a)(1) which was contained in OSHA inspection 311909980 Citation 1, Item 4 issued on February 5, 2009 and became a final order on March 8, 2009 with respect to a worksite located at 2807 Champa St., Denver, CO 80204.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems:    a)  On or about August 12, 2011, employees were exposed to cave-in hazards in that, daily inspections of the trench and adjacent areas were not performed to ensure that hazardous conditions were not present.    Perkins Excavating, LLC was previously cited for a violation of this Occupational Safety and Health Standard, or its equivalent 29 CFR 1926.651(k)(1) which was contained in OSHA inspection 311909980 Citation 1, Item 3 issued on February 5, 2009 and became a final order on March 8, 2009 with respect to a worksite located at 2807 Champa St., Denver, CO 80204.
