29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets. On or about 8/22/11 during the caulking and painting of a commercial building, the employer did not ensure that hard hats were worn when employees were exposed to overhead hazards.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps,walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall beused. Crossbraces shall not be used as a means of access. On or about 8/24/11 during the caulking and painting of a commercial building, the employer did not ensure employees had proper access to a fabricated frame scaffold.
