29 CFR 1926.652(c)(2)(i):     Design of support systems, shield systems, or other protective systems drawn from manufacturer's tabulated data were not in accordance with all specifications, recommendations, and limitations issued or made by the manufacturer.    A trench box being used to protect an employee from cave-in did not follow the design specifications of the manufacturer due to use with the north end top spreader bar missing sections on each side of the central part of the spreader bar.    Abatement certification is required per 29 CFR 1903.19(c).

29 CFR 1926.652(d)(3):     When material or equipment used for protective systems was damaged, a competent person did not examine the material or equipment and evaluate its suitability for continued use. The competent person did not assure the material or equipment was able to support the intended loads or was otherwise suitable for safe use, removing the material or equipment from service, to be evaluated and approved by a registered professional engineer before being returned to service.    The competent person failed to adequately examine and remove from service the upper stacked trench box whose north end top support bar was missing sections on each side of the central support bar.
