OSH ACT of 1970 Section (5)(a)(1):     Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to ejection / crushing injuries.    (a) Wildcat Mountain - Emergency brake lever was removed.    (b) Wildcat Mountain - Employer did maintain a preventative maintenance program for the Muskeag Tractor.    (c) Wildcat Mountain - The operator cab of the Muskeag Tractor was removed.    (d) Wildcat Mountain - Employees were not properly trained in for use of the Muskeag Tractor.
