29 CFR 1926.501(b)(13):     Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor  did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.    On October 4, 2011 at a worksite located at 3766 Butterfield Road, Winnebago IL. Employees were working on a residential roof and not utilizing fall protection. Employees were exposed to a fall hazard of approximately 16.5 feet.

29 CFR 1926.1053(b)(1):     Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:    On October 4, 2011 at a worksite located at 3766 Butterfield Road, Winnebago IL. Employees were using a ladder to access the roof. The ladder was not extended three feet above the landing surface exposing employees to a fall hazard.

29 CFR 1926.1053(b)(16):     Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired.    On October 4, 2011 at a worksite located at 3766 Butterfield Road, Winnebago IL. Employees were using a ladder to access the roof. The top step of the ladder was bent resulting in the ladder having a structural defect.      Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
