29 CFR 1904.7(b)(3): The employer did not record an injury or illness that involves one or more days away from work, on the OSHA 300 log with a check mark in the space for cases involving days away from work:    a) On or about September 13, 2011, Pinon Management dba Christopher House, as the creating and controlling employer, did not ensure that Conifer Care Communities dba Christopher House recorded the following workplace injuries and illnesses correctly on the OSHA 300 Log for calendar year 2008:    On or about May 16, 2008, Entry #801 was recorded as a job transfer Column (I), when the case resulted in both days away from work as well as job restriction Column (I). The correct recording should be a check in Column (H), 4 days in Column (K) and 11 days in Column (L).    On or about July 4, 2008, Entry #803 was recorded with 3 days in Column (K). The correct recording should also include a check In Column (H).    On or about October 19 2008, Entry #806 was recorded with a check in Column (I) and 5 days in Column (K). The correct recording should be a check in Column (H), 4 days in Column (K) and 11 days in Column (L)      b) On or about September 13, 2011, Pinon Management dba Christopher House, as the creating and controlling employer, did not ensure that Conifer Care Communities dba Christopher House recorded the following workplace injuries and illnesses correctly on the OSHA 300 Log for calendar year 2009:    On or about August 22, 2009, Entry #906 was recorded with a check in Column (L), 2 days in Column (K) and as an injury in Column (M1).  The correct recording should be a check in Column (H), 2 days in Column (K), 60 days in Column (L) and a check in Column (M1). The employers corrected OSHA 300 form has this entry now renumbered as Entry #903.      c) On or about September 13, 2011, Pinon Management dba Christopher House, as the creating and controlling employer, did not ensure that Conifer Care Communities dba Christopher House recorded the following workplace injuries and illnesses correctly on the OSHA 300 Log for calendar year 2011:    On or about January 21, 2011, Entry #912 was only recorded as a job restriction in Column (I). The correct recording should be a check in Column (H), 8 days in Column (K) and 180 days in Column (L).    On or about April 15, 2011, Entry #917 was recorded as a job restriction with a check in Column (I) and 2 days away from work in Column (K).  The correct recording should be a check in Column (H) , 2 days in Column (K) and 15 days in Column (L).     On or about August 20, 2011, Entry #918 was recorded as a job restriction in Column (I). The correct recording should be a check in Column (H), 2 days in Column (K) and 15 days in Column (L).      Definitions:  Column (H) is to record Days Away From Work.  Column (I) is to record Days of Job Transfer or Restriction. Column (J) is to record Other Recordable Cases. Column (K) is to record the number of days away from work. The correct recording should also include 13 days of restricted activity in Column (L).      b) On or about September 13, 2011, Pinon Management dba Christopher House, as the creating and controlling employer, did not ensure that Conifer Care Communities dba Christopher House recorded the following workplace injuries and illnesses correctly on the OSHA 300 Log for calendar year 2011:    On or about February 24, 2011, Entry #915 was only recorded as an injury in Column (M1). The correct recording should also have a check for Other Recordable Cases Column (J).    On or about October 19, 2008, Entry #805 was recorded with 1 day in Column (K).  The correct recording should also include a check in Column (J).      b) On or about September 13, 2011, Pinon Management dba Christopher House, as the creating and controlling employer, did not ensure that Conifer Care Communities dba Christopher House recorded the following workplace injuries and illnesses correctly on the OSHA 300 Log for calendar year 2009:    On or about January 10, 2009, Entry #901 which required medical attention was only recorded as an injury in Column (M1).  The correct recording should also include a check in Column (J).    On or about February 7, 2009, Entry #902 which required medical attention was only recorded as an injury in Column (M1). The correct recording should also include a check in Column (J).    On or about August 3, 2009, Entry #905 which was a needles stick incident was only recorded in Column (M1). The correct recording should also include a check in Column (J).  The employers corrected OSHA 300 form now has this entry renumbered as Entry #904.    On or about November 8, 2009, Entry #907 which was a needle stick incident was only recorded in Column (M1).  The correct recording should also include a check in Column (J).  The employers corrected OSHA 300 form now has this entry renumbered as Entry #905      c) On or about September 13, 2011, Pinon Management dba Christopher House, as the creating and controlling employer, did not ensure that Conifer Care Communities dba Christopher House recorded the following workplace injuries and illnesses correctly on the OSHA 300 Log for calendar year 2010:    On or about March 20, 2010, Entry #902, which required medical attention, was only recorded as an injury in Column (M1). 29 CFR 1904.29(b)(3): Each Recordable injury or illness was not entered on the OSHA 300 Log and/or an incident report (OSHA 301 form or equivalent) within seven (7) calendar days of receiving information that a recordable injury or illness occurred:    a) On or about September 13, 2011, Pinon Management dba Christopher House, as the creating and controlling employer, did not ensure that Conifer Care Communities dba Christopher House timely recorded the following injuries on the OSHA 300 Form.     An injury occurring on January 7, 2011 was not recorded on the OSHA 300 for the Year 2011 within 7 calendar days of receiving information that a recordable injury had occurred.  Entry #910 resulted in days of restricted activity. Column (L ), the number of days of restricted activity, was blank. Column (L) should have been recorded as 59 days.    An injury occurring on January 21, 2011 was not recorded on the OSHA 300 for the Year 2011 within 7 calendar days of receiving information that a recordable injury had occurred. Entry #912 resulted in both days away from work and days of restricted activity.  Both Column K (number of days away from work) and Column L (number of days of restricted activity) were blank. Column (K) should have been recorded as 8 days and Column (L) should have been recorded as 180 days.      Definitions:  Column (H) is to record Days Away From Work. 29 CFR 1904.32(b)(2)(i):  The employer failed to complete the Summary of Work-Related Injury and Illnesses  (OSHA 300A or equivalent) with the total of the columns on the OSHA 300 Log (If you had no recordable cases, enter zeros for each column total):    a) On or about September 13, 2011,  Pinon Management dba Christopher House, as the creating and exposing employer, did not ensure that Conifer Care Communities dba Christopher House adequately completed the OSHA 300A Form:    The employers OSHA 300A (or equivalent) for the years 2008, 2009 and 2010 contained blanks for Column (L). Column (L) is the total number of days of job transfer or restriction.    The employers OSHA 300A (or equivalent) for the Year 2008 contained incorrect totals in Columns (I), (J), (K), (L) and (M1).   The DART rate with these incorrect totals was 4.2. The DART calculation with correct totals was 5.6.    The employers OSHA 300A (or equivalent) for the Year 2009 contained incorrect totals in Columns (I), (J), (K), (L), and (M1). The DART rate with these incorrect totals was 2.8 The DART calculation with correct totals was 1.3.    The employers OSHA 300A (or equivalent) for the Year 2010 contained incorrect totals in Columns (H), (I), (J), (K), (L) and (M1).
