The in-plant handling, storage, and utilization of all compressed gases incylinders, portable tanks, rail tankcars, or motor vehicle cargo tanks shall be in accordance with Compressed Gas Association Pamphlet P-1-1965, whichis incorporated by reference as specified in Sec. 1910.6. a) At the establishment, the compressed helium tank, used to blow-up balloons, was not secured to prevent it from being "knocked over" exposing employees to a projectile hazard.

29 CFR 1910.157(e)(3): The employer shall assure that portable fire extinguishers are subjected to an annual maintenance check. Stored pressure extinguishers do not require an internal examination. The employer shall record the annual maintenance date and retain this record for one year after the last entry or the life of the shell, whichever is less. The record shall be available to the Assistant Secretary upon request. a) At the establishment, the portable fire extinguisher located in the garage area had not received an annual maintenance check exposing employees to a potential fire hazard. The fire extinguisher had last been inspected in May 2005 and at the time of the on-site inspection was found to have been discharged.
