OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and struck by hazards. On or about September 24, 2011 and at times prior thereto, employees were exposed to hazards such as but not limited to struck by and falls of approximately 20 feet while working from an elevated platform.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: On or about September 24, 2011 and at times prior thereto, employees were exposed to falls of approximately 20 feet to the ground below while framing and roofing without fall protection.
