29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): KZ Smith & Company, at 825 S Adams Street, Denver, CO: On and preceding 11/14/11, KZ Smith & Company did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person. KZ Smith & Company directed Schott Construction LLC and MJ Hicks Construction LLC to perform framing work at a home construction site. A wooden job built scaffold did not have guardrails installed nor was the platform fully planked. Workers were not protected by guardrails where window wells with a depth greater than six feet were present. KZ Smith & Company did not perform an inspection of the worksite and equipment to ensure that employees of Schott Construction LLC and MJ Hicks Construction LLC were not exposed to a hazardous work condition. This condition exposed employees of Schott Construction LLC and MJ Hicks Construction LLC to fall hazards.

29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide: KZ Smith & Company, at 825 S Adams Street, Denver, CO: On 11/14/11, KZ Smith & Company did not ensure that each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide. KZ Smith and Company directed MJ Hicks Construction LLC to install soffit framing on the multistory home's roofs. One employee of MJ Hicks Construction LLC worked from a wooden job built scaffold to frame a second story roof's soffit. The L-shaped scaffold was secured to the first floor roof and the platform was constructed of parallel lines of 2 x 10 planks. An approximate gap of twelve inches was between the lines of planks. The employer did not ensure that the scaffold platform was fully planked. This condition exposed one employee of MJ Hicks Construction LLC to an approximate twelve foot six inch fall hazard.

KZ Smith and Company directed MJ Hicks Construction LLC to install soffit framing on the multistory home's roofs. One employee of MJ Hicks Construction LLC worked from a wooden job built scaffold to frame a second story roof's soffit. The scaffold was secured to the first floor roof and the platform was constructed of 2 x 10 planks. The platform did not have guardrails. KZ Smith & Company did not ensure that guardrail systems were installed along the sides and ends of the scaffold. This condition exposed one employee of MJ Hicks Construction LLC to an approximate twelve foot six inch fall hazard.

KZ Smith & Company directed Schott Construction LLC to install windows. One employee of Schott Construction was installing flashing around a patio door adjacent to a large window well. The approximate depth of the window well was six feet nine inches. The employee was not protected from falling into the hole by a guardrail system erected around the hole. This condition exposed one employee of Schott Construction LLC to an approximate six foot nine inch fall hazard. KZ Smith & Company, at 825 S Adams Street, Denver, CO: On or about 11/14/11, KZ Smith & Company did not ensure that each employee on walking/working surfaces was protected from falling through a hole more than 6 feet (1.8 m) above the lower level, by personal fall arrest systems, covers, or guardrail systems erected around the hole. KZ Smith & Company directed construction of a home. A window well was located on the west side of the home adjacent to where workers walked. The approximate depth of the window well was seven feet five inches. Workers were not protected from falling into the hole by a guardrail system erected around the hole. This condition exposed workers to an approximate seven foot five inch fall hazard.
