29 CFR 1926.652(a)(1):     Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b).    a)  On or about November 15, 2011, Fox Excavating, Inc. employees were exposed to cave-in hazards while making water main connections in an excavation 6.2 feet deep.    b)  On or about November 16, 2011, Fox Excavating, Inc. employees were exposed to cave-in hazards while making water main connections in an excavation 6.2 feet deep.     Fox Excavating, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 311250153, citation number 2, item number 1 and was affirmed as a final order on June 2, 2008 with respect to a workplace located at 2030 Main Street, Batavia, Illinois.       Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
