29 CFR 1926.20(b)(2):     29 CFR 1926.20 (b)(2) The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer.    a)67 Moorlinch Blvd., Medford, NJ:  Employees were exposed to multiple jobsite hazards.  Workers onsite were observed installing the scratch-coat preliminary layer for the homes stucco finish.  A worker was observed installing cement mixture on a 2nd floor dormer using the roof as his walking working surface.  The worker traversed between the roof and a welded tubular frame scaffold via two unsupported scaffold planks.  At no time was the employee provided with any means of fall protection (PFAS, positioning system, safety nets, guardrails, etc.).  The employee was exposed to a fall hazard greater than 13 feet to the ground.  Deficiencies noted in the scaffold including but were not limited to; work platforms not fully planked, overlapped planking not properly supported, improper and unstable foundations, and improper access to elevations.  Additionally, Portland cement (a known corrosive) was noted was being used on the jobsite.  No MSDS sheets or information was available to employees for this substance.  The employer, New Britain Stone and Stucco, LLC, had not initiated a program for a competent person to conduct frequent and regular inspections of the jobsite, to identify hazards and/or stop the work in the event workers were placed in a hazardous condition.  Observed on or about 02/07/2012    NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

A worker was observed traversing a scaffold on which each working level was not fully planked.  The area that the employee was observed to be walking/working contained only two scaffold planks. 29 CFR 1926.451(c)(2)(i):     Footings were not level, sound, rigid, and capable of supporting the loaded scaffold without settling or displacement:      a)  67 Moorlinch Blvd., Medford, NJ: Employees onsite were observed installing the scratch-coat preliminary layer for the home's stucco finish.  The scaffold legs, with screw outs and mud plates were noted to bear on a piece of dimensional lumber that was unstable and incapable of supporting the scaffold without displacement due to bridging a large hole in the ground.  The footing board, and thus the scaffold,  was noted to flex and move as workers traversed the scaffold.  Observed on or about 02/07/2012.    NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(e)(1):     When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.    a)  67 Moorlinch Blvd., Medford, NJ:  An employee was observed traversing a scaffold to which no proper means of access was provided.  No ladders were positioned to provide access to the upper working surface.  CSHO observed the employee dismounting the scaffold via climbing on the cross braces.
