Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being pinned under, crushed, or thrown from a forklift truck when not wearing a seat belt.    (a)   On or about February 9, 2012, and at times prior thereto, a Gradall telehandler forklift, was being operated without the use of the seat belt.

29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems:      (a)  On or about February 9, 2012, employees were working in and around West facing window openings and were exposed to falls to the ground of approximately 14 feet.     (b)  On or about February 9, 2012, employees were working in and around several South facing window openings and were exposed to falls to the ground of approximately 15 feet or more.    (c)  On or about February 9, 2012, employees were working in and around poorly constructed guardrail system with missing mid-rails on the stairway of the residence and were exposed to a range of falls to the basement level of approximately 8-12 feet.      Note:  Abatement certification is NOT required for this item.  Quick fix was applied.

29 CFR 1926.602(c)(1)(viii)(A):  The safety platform was not firmly secured to the lifting carriage and/or forks.    (a)  On or about February 9, 2012, and at times prior thereto, employees were working off of a unsecured plywood platform, approximately five feet above the ground.        Note: Abatement certification IS required for this item.
