29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level was not guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides and railings were not provided with toeboards where required:    a) Linden Bulk Transportation Co., Inc., 4200 Tremley Point Rd., Linden NJ facility - Wash Bay: The railings on approximately five (5) platforms were not provided with toeboards to prevent materials such as, but not limited to buckets with liquid contents from falling approximately ten (10) feet high on to persons that pass beneath the open sides of the platforms.      Condition noted on/about February 15, 2012.

29 CFR 1910.36(d)(1): Employees must be able to open an exit route door from the inside at all times without keys, tools, or special knowledge. A device such as a panic bar that locks only from the outside is permitted on exit discharge doors.    Linden Bulk Transportation Co., Inc., 4200 Tremley Point Rd., Linden NJ facility - Wash Bay:  The Employer did not ensure that the exit doors were unlocked and are able to be opened without special knowledge to provide free and quick exiting in case of an emergency.      a) Southeast emergency exit door (by Bay 5) was locked by a sliding metal door lock.      b)The panic bar of the South emergency exit door (by Wash Bay Office) was not maintained in order for the emergency exit door to be opened without special knowledge to provide free and quick exiting in case of an emergency.  The horizontal bar of the panic bar was loose and not secured to the door.      c)The panic bar of the Northwest emergency exit door was not maintained in order for the emergency exit door to be opened without special knowledge to provide free and quick exiting in case of an emergency. Components of the panic bar were missing from the door.      Condition noted on/or about February 29, 2012.
