29 CFR 1910.141(b)(1)(iii): Potable drinking water dispensers were not designed, constructed, and serviced so that sanitary conditions are maintained:    The employer did not ensure that the potable drinking water was designed and constructed to meet sanitary conditions.  Employee drinking water was dispensed from an outdoor water pipe located in unsanitary conditions between a portable toilet and a storage facility.  Condition noted on 02/16/12.     NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER CFR 1903.19.

29 CFR 1910.141(c)(1)(i): Except as otherwise indicated in this paragraph (c)(1)(i), toilet facilities, in toilet rooms separate for each sex, were not provided in all places of employment in accordance with table J-1 of this section:    The employer did not provide an adequate number of toilet facilities according to table J-1 for employees who work at this location.  Only 2 toilet facilities were provided when based on table J-1 at least 3 are required for the 50 workers onsite.  Condition noted on 02/16/12.
