29 CFR 1926.602(d): Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178.     29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    a) The employer provided employees with a JLG G10-55A all terrain forklift without ensuring that the assigned operator(s) was competent to operate the equipment safely, as demonstrated by successful completion of forklift training and evaluation.    No abatement certification or documentation required for this violation.

29 CFR 1926.451(b)(3): Where guardrails were not installed along the front edge of the platform or all employees were not protected from falling with the use of personal fall arrest systems, the front edge of the scaffold platform was more than 14 inches from the face of the work:    a) The front edge of the scaffolding platform from which employees worked at an elevation of approximately 19 feet was approximately 24 inches from the face of the work.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    a) Employees were exposed to the hazard of falling approximately 21 feet while working without fall protection along the unprotected side/edge of the roof of the building where exterior renovations were being conducted.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
