OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.    Starboard deck hydraulic room:  On or about February 16, 2012 and times prior thereto, employees were exposed to live electrical equipment  inside panel 7 that was energized to 440 volts 60 hz.  Contact with the energized parts could result in significant trauma up to including electrocution.    Among other methods one feasible and accepetable method is to close and secure the panel.

29 CFR 1910.23(a)(2):     Every ladderway floor opening or platform shall be guarded by a standard railing with standard toeboard on all exposed sides (except at entrance to opening), with the passage through the railing either provided with a swinging gate or so offset that a person cannot walk directly into the opening.    Aft Starboard crane:  On or about February 16, 2012 and times prior thereto, the access area on the crane was a chain rail that measured 33 inches high.  This exposed employees to a 10 foot fall to the deck or overboard if the crane was rotated in the direction where the opening was rotated to the outside.    Boiler Room Area:  on or about February 16, 2012, and times prior thereto, a platform adjacent to the boilers was not protected by a swinging gate or offset to preclude walking into a ladderway;  exposing employees to a 7 foot fall hazard to the deck below.

29 CFR 1910.23(a)(9):  Every floor hole into which persons cannot accidentally walk (on account of fixed machinery,equipment, or walls) shall be protected by a cover that leaves no openings more than 1 inch wide. The cover shall be securely held in place to preventtools or materials from falling through.    (a)  Reefer Flat Area (adjacent to the "Maine Exit"):  On or about 2/16/2012, and times prior thereto, 2 floor holes,  measuring 8.5 inches by 11.75 inches and a 10.75 inch round hole were not covered in an area where employees were working; exposing employees to the hazard of tripping or breaking bones if their foot went into the hole.
