The portable ladder was not secured at its top to a rigid support, and a grasping device, such as a grabrail, was not provided to assist employees in mounting and dismounting the ladder:    a) On or about 02/28/12 CSHO observed one man doing rip and tear from the lower roof when the portable ladder he used to gain access to this roof did not extend three feet above the landing.

29 CFR 1926.501(b)(13):   Each employee engaged in residential construction activities 6 feet or more above the lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, nor was an alternative fall protection plan which meets the requirements of 29 CFR 1926.502(k) developed and implemented:    * 1 Full Body Harness  * 1 Combination 5/8" rope grab with attached 2' shock absorber  * 1 50 ft 5/8" blend rope lifeline with attached snap hook  * 1 Reusable roof anchor bracket    a) On or about 02/28/12 CSHO observed two men working on and from a 12/12 pitch roof installing new roofing materials and a third man was doing rip and tear on the lower roof with no fall protection systems in place.     Repeat  Willy Construction was previously cited for serious violations of this Occupational Safety and Health standard or its equivalent standard, 29 CFR 1926.0501(b)(13) which was contained in OSHA Inspection Number 313980369, Citation # 1, Item # 1, issued on 06/03/2010 with respect to a work place located at 882 Westfield Avenue, Roselle Park, NJ 07204 and became a final order on 08/25/2010.
