29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.        Employees working on the thrid floor at the 500 North Grand, St. Louis MO job site was not protected from falling through wall openings (2) to the roof of the court yard area at the following locations:    a. On the north wall of the court yard an employee stood in front of the 4' by 8' plywood sheet that was covering the window opening leaving no fall protection as he communicated with the lift operator.      b. On the east wall of the court yard an employee went under the guard rail which measured an estimated 44 inches off the floor as he stood inthe window opening with not fall protection.  The window did not have a mid rail installed as the employee communicated with the lift operator.      Abatement certification and abatement documentation is required for this violation.  The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful.  The abatement certification sheet is enclosed with the citation(s).
