29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surfaces were not used as a means of access: a) On or about March 8, 2012, masonry employees were exposed to fall hazards because the employer did not esure the use of a ladder or other adequate means for employees to access two levels of scaffolding. Employees were observed climbing the scaffold frame and bracing in order to access the scaffold platforms.

29 CFR 1926.451(g)(4)(vii): Each toprail or equivalent member of a guardrail system was not capable of withstanding, without failure, a force applied in any downward or horizontal direction at any point along its top edge of at least 100 pounds for guardrail systems installed on single-point adjustable suspension scaffolds or two-point adjustable suspension scaffolds, and at least 200 pounds for guardrail systems installed on all other scaffolds: a) On or about March 8, 2012, and at times prior, employees working from a fabricated frame scaffold were exposed to fall hazards of over 10 feet because the employer did not install toprails that were capable of withstanding a downward or horizontal force of at least 200 pounds. The employer allowed some guardrails to be constructed of two rail pieces joined together by wire in the middle of their horizontal run between frame pieces.
