29 CFR 1926.451(e)(1):  When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surfaces were not used as a means of access:    a)  On or about March 8, 2012, masonry employees were exposed to fall hazards because the employer did not esure the use of a ladder or other adequate means for employees to access two levels of scaffolding.  Employees were observed climbing the scaffold frame and bracing in order to access the scaffold platforms.

29 CFR 1926.451(h)(1):  In addition to wearing hardhats each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, or guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects:      a)  On or about March 8, 2012, the employer did not install toeboards or other means of protection to prevent employees working around a scaffold from being struck by falling tools or equipment.
