29 CFR 1926.95(a): "Application." Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.    a.  On March 14, 2012, at the above addressed jobsite, an employee conducting bridge renovation operations was not wearing his tight fitting half mask respirator, thereby exposing the employee to the hazards associated with silica.

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, were not rigged such that an employee can neither free fall more than 6 feet (1.8 m), nor contact any lower level;    a.  On or about March 14, 2012, at the above addressed jobsite, an employee conducting bridge renovation operations was not protected from free falling more than six (6) feet, thereby exposing the employee to the hazards associated with falls.
