OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    a)  On or about March 14, 2012, and at times prior, employees were exposed to struck-by and crushed-by hazards because the rough terrain forklift that they operated used to elevate personnel was not set on level ground (nor leveled) and was operated by an operator who was unfamiliar with the operator's manual.

29 CFR 1926.501(b)(13):  Employee(s) engaged in residential construction activities 6 feet (1.8m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were other provisions of paragraph (b) of this section used to provide an alternative fall protection measure:      a)  On or about March 14, 2012, employees were exposed to falls greater than 6 feet while performing work which included siding installation without adequate fall protection measures in place.      b)  On or about April 19, 2012, employees were exposed to falls greater than 6 feet while performing work from a rooftop without adequate fall protection measures in place.

29 CFR 1926.502(d)(21):  The employer did not ensure that personal fall arrest systems were inspected prior to each use for wear, damage and other deterioration, and that defective components were removed from service:    a)  On or about March 14, 2012, and at times prior, employees were exposed to falls while working on a third floor balcony and wearing visibly damaged fall arrest equipment which had not been inspected nor removed from service.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard was introduced into their work area:                              a)  On or about March 14, 2012, and at times prior, employees working with Hardie Board and exposed to dust containing silica were not provided with training which effectively covered the hazards of the silica contained in the boards and the methods which should be employed to safely use the boards.
