29 CFR 1910.23(c)(1):     Open-sided floor(s) or platform(s) 4 feet or more above the adjacent floor or ground level were not guarded by standard railings (or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v)), on all open sides:    1) Powder Room- On or about 03/20/12, employees were required to work from a platform at a height of 8 feet without a standard guard railing system or equivalent. Employees were thereby exposed to the hazards associated with falls.

29 CFR 1910.23(d)(1)(iii):     Stairway(s) less than 44 inches wide having both sides open, did not have one stair railing on each side:    1) Powder Room- On or about 03/20/12, employees were required to use unprotected (no mid-rails) platform stairs when mixing product. Employees were thereby exposed to the hazards associated with falls.       2) Liquid Room- On or about 03/20/12, employees were required to use unprotected (no mid-rails) platform stairs when mixing product. Employees were thereby exposed to the hazards associated with falls.    3) Bulk Storage Area- On or about 03/20/12, employees were required to use unprotected (no mid-rails) platform stairs when maintaining and servicing bulk storage tanks. Employees were thereby exposed to the hazards associated with falls.

29 CFR 1910.147(c)(1):     The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:    1) Metal Finishing Research- On or about 03/20/12, the employer did not establish an energy control (lockout/tagout) program which includes energy control procedures, employee training and periodic inspections to ensure employees performing servicing or maintenance on machinery or equipment, such as the Liquid and Powder mixing machines.

29 CFR 1910.212(a)(1):     One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    1) Powder Room- On or about 03/20/12, the employer failed to provide adequate guarding for rotating parts of the mixing machines. Employees were exposed to coming in contact with the rotating blades.     2) Liquid Room- On or about 03/20/12, the employer failed to provide a guard for the rotating parts of a mixing machine. Employees were exposed to coming in contact with the rotating blades.
