29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.    A. Don Kerr worksite located at 1236 East Meadow Dr., Oregon, Ohio: On or about March 28, 2012, the employer did not ensure employees were wearing proper eye protection while operating a pneumatic nail gun while performing weatherproofing activities on the residential structure. The employees were exposed to potential flying object hazards while operating the pneumatic fasteners.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.     A. Don Kerr worksite located at 1236 East Meadow Dr., Oregon, Ohio: On or about March 28, 2012, the employer did not ensure employees were protected from falls while performing weatherproofing activities on the residential structure.  The employees were exposed to a potential 9-6 fall to the level below.

29 CFR 1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access.     A. Don Kerr worksite located at 1236 East Meadow Dr., Oregon, Ohio: On or about March 28, 2012, the employer did not ensure the side rails of the ladder extended at least three feet above the landing surface. Employees were exposed to falls while using the ladder to access the working surface.
