29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.    a.  On or about April 3, 2012, at the above addressed jobsite, an inspection was not conducted by a competent person  capable of correcting hazards, such as falls and missing excavator windows, which could result in employee injuries.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    a. On or about April 3, 2012, at the above addressed jobsite, an employee performing demolition operations from the second floor was exposed to a fall, of ten (10) feet  nine (9") inches, created by the presence of unprotected sides.

29 CFR 1926.600(a)(5): All cab glass shall be safety glass, or equivalent, that introduces no visible distortion affecting the safe operation of any machine covered by this subpart.      a.  On or about April 3, 2012, at the above addressed jobsite, an employee was conducting demolition operations in a Caterpillar 330C hydraulic excavator without cab glass, thereby exposing the employee to the hazards associated with being struck-by materials.
