29 CFR 1926.501(b)(13) Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: 1) At the jobsite, employees replacing shingles on a low slope residential roof were not protected by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, warning line system and personal fall arrest system, warning line system and safety monitoring system, or on roofs 50-feet (15.25m) or less in width the use of a safety monitoring system alone. The width of this residential roof measured approximately 40 feet. The slope of the residential roof was approximately 3:12. The fall hazard was approximately 9 feet.
