29 CFR 1926.451(g)(1):  Each employee on a scaffold more than 10 feet (3.1 m) above a lower level was not protected from falling to that lower level.           (A) Eshelman Construction, LLC, 319 West Bleeker St., Aspen, CO 81611:  On and before April 9, 2012, the exposing and controlling employer did not ensure that two employees working off a pump jack scaffold system were protected from falling by adequate fall protective measures.  Employee was observed standing on a 2" x 6" wooden board being used a the top guard rail to perform work in the gutter/roof edge area.  Condition exposed employee to fall hazards of greater than 15 feet.

29 CFR 1926.451(f)(3):  Scaffolds and scaffold components where not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity.          (A) Eshelman Construction, LLC, 319 West Bleeker St., Aspen, CO 81611:  On and before April 9, 2012, the exposing and controlling employer did not verify that a pump jack scaffold system being used by two employees to perform edge work was at the proper height to ensure that the employees could use the system safely.  Due to the scaffolds improper height, employee was seen standing on a 2" x 6" wooden beam being used a guard rail on the pump jack system to perform work on the roofs edge.  Condition exposed employee to fall hazards of greater than 15 feet.

29 CFR 1926.454(a): The employer did not have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.           (A) Eshelman Construction, LLC, 319 West Bleeker St., Aspen, CO 81611:  On and before April 9, 2012, the exposing and controlling employer did not ensure that employees were trained in the hazards associated with the use of a pump jack scaffold system and ho wto minize those hazards.  This lack of training resulted in a pump jack scaffold system being used by two employees to perform edge work not being at the proper height to perform the work safely.  Due to the scaffolds improper height, employee was seen standing on a 2" x 6" wooden beam to perform work on the roofs edge.  Condition exposed employee to fall hazards of greater than 15 feet.
