29 CFR 1926.651(k)(2): Where the competent person finds evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees shall be removed from the hazardous area until the necessary precautions have been taken to ensure their safety. a) Jobsite at 814 Boyd Avenue, Pittsburgh, PA: On or about 4/13/12, a competent person failed to remove an employee that was exposed to a possible cave-in while installing a sewer line in an unprotected, 8 foot deep excavation with near vertical sidewalls.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926(b)(1)(i) in that the excavation was sloped at an angle steeper than one and one half horizontal to one vertical (34 degrees measured from the horizontal): a) Jobsite at 814 Boyd Avenue, Pittsburgh, PA: On or about 4/13/12, an employee was working in an excavation that measured approximately 8 feet in depth with near vertical sidewalls and was not protected from cave-ins by an adequate protective system. This condition exposed the employee to entrapment in the event of a cave-in of the unprotected excavation.
