Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish a place of employment, which was free from recognized hazards that was causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire hazards:    Employees, working in the area of the FermaSure storage tank, were exposed to fire hazards and the employer did not provide secondary containment for the FermaSure storage tank.    Among other methods, the following is a feasible and acceptable method to correct this hazard.  Design and install an independent and dedicated secondary containment system for the FermaSure storage tank as described in the DuPont FermaSure Properties, Uses, Storage, and Handling of 2009.

29 CFR 1910.1200(h)(1):  Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard was introduced into their work area:    Employees were exposed to FermaSure and the employer did not perform training and communicate information to employees to address the chemical hazards and chemical handling.
