29 CFR 1910.1200(g)(1): The employer did not have a material safety data sheet for each hazardous chemical which they used:     At the Rig 236 drilling site located at Borchers Koenning Unit #1H in Gonzales County, Texas, on or about March 21, 2012 and at times prior thereto, the employer did not have material safety data sheets for employees who were using hazardous chemicals for rig maintenance including, but not limited to, flammable Sigmarine 48 Alkyd Gloss [7238-1225 Gray and 7238-S1354 Orange] containing Stoddard Solvent and trimethylbenzene, flammable Thinner 21-06 (xylene, ethyl benzene), and flammable Methyl Alcohol.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that the employer has a material safety data sheet for each hazardous chemical which they use.

29 CFR 1910.1200(f)(5):  The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged, or marked with the identity and appropriate hazard warnings regarding the chemicals contained therein:    At the Rig 236 drilling site located at Borchers Koenning Unit Well #1H in Gonzales County, Texas, on or about March 21, 2012 and at times prior thereto, employees were dispensing combustible diesel fuel from a Western Petroleum skid-mount storage tank for use in mud mixing operations, and the tank was not labeled with the contents or hazard warnings.  The Patterson-UTI Drilling Company LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.1200(f)(5), which was contained in OSHA inspection number 314657131, citation number 1, item number 2, and was affirmed as a final order on 10/19/2010 with respect to a workplace located at Light Gulch, Rig #303, Parachute, CO 81635.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each container of hazardous chemicals in the workplace is labeled, tagged, or marked with the identity and appropriate hazard warnings regarding the chemicals contained therein.
