29 CFR 1926.651(k)(2):     Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety.    (a) Jobsite:  On or about April 26, 2012, the competent person did not remove an employee that was working (checking the grade with a story pole) in the 5 foot 4 inch deep excavation.        Alton Industries Inc. was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1926.651(k)(2), which was contained in OSHA inspection number 310292412, citation number 1, item number 3 and was affirmed as a final order on 5/28/2008, with respect to a workplace located at 2476 Washington Road, Canonsburg, PA 15317.

29 CFR 1926.652(a)(1):     Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was not properly sloped:    (a) Jobsite:  On or about April 26, 2012, an employee was working (checking the grade with a story pole) in a 5 foot 4 inch deep excavation and the excavation was not sloped, shored nor properly benched.     Alton Industries Inc. was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1926.652(a)(1),which was contained in OSHA inspection number 312092412, citation number 1, item number 4, and was affirmed as a final order on 5/28/2008, with respect to a workplace located at 2476 Washington Road, Canonsburg, PA 15317.
