29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or 1926.652(c):     (a)  Jobsite:  On or about May 28, 2015, an employee was working in an approximately 15 foot deep excavation and he was not protected from a cave-in.         The Alton Industries Inc. was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 406684, Citation Number 1, Item Number 2 and was affirmed as a final order on 6/12/12, with respect to a workplace located at near Popular Street, Canonsburg, PA.     In addition, the Alton Industries Inc. was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA Inspection Number 310292412, Citation Number 1, Item Number 4, and was affirmed as a final order on 5/28/2008, with respect to a workplace located at 2476 Washington Road, Canonsburg, PA.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:        (a) Jobsite:  On or about May 28, 2015, the competent person did not take the necessary precautions to prevent cave-ins and he allowed an employee to work in a part of the 15 foot deep excavation that was not protected by shoring or sloping.  In addition, no soil testing was done to determine the class of soil that the employees were working in.
