29 CFR 1910.107(c)(6):  Electrical wiring and equipment not subject to deposits of combustible residues but located in a spraying area as herein defined were not explosion-proof type approved for Class I, group D locations and did not otherwise conform to the provisions of subpart S of this part, for Class I, Division 1, Hazardous Locations:    (a)  Stambaugh Metal, Incorporated, 802 High Street, Hanover, PA - An exposed employee spray painted metal objects and parts with flammable liquid paint within an approximate four (4) foot vicinity of a light fixture that was not explosionproof and hung down from the ceiling approximately three (3) feet, exposing the employee to a fire hazard, on or about April 3, 2012.    Abatement certification required within 10 days after abatement date.   The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 1910.134(c)(1)(i)-(ix) with worksite specific procedures was not established and implemented for required respirator use:    (a)  Stambaugh Metal, Incorporated, 802 High Street, Hanover, PA - Employees working in the Polishing room and Belter area were required to wear 3M, N-95 filtering facepieces.  In addition, an employee working in the spray paint booth/finishing and degreaser area voluntarily wore a North 7700 half-mask, tight-fitting respirator.  A written respiratory protection program was not available which would include required elements such as written procedures for selecting respirators, medical evaluations of employees required to use respirators, fit testing, procedures for cleaning, inspecting, and storing respirators, etc., on or about April 3, 2012.    Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
