29 CFR 1926.405(a)(2)(ii)(B): Branch circuits shall originate in a power outlet or panelboard. Conductors shall be run as multiconductor cord or cable assemblies or open conductors, or shall be run in raceways. All conductors shall be protected by overcurrent devices attheir ampacity. Runs of open conductors shall be located where the conductors will not be subject to physical damage, and the conductors shall befastened at intervals not exceeding 10 feet (3.05 m). No branch-circuit conductors shall be laid on the floor. Each branch circuit that suppliesreceptacles or fixed equipment shall contain a separate equipment grounding conductor if the branch circuit is run as open conductors. a. On or about May 2, 2012 - at the above addressed jobsite, an employee using an electric jackhammer was working around conductors that were not protected from physical damage, thereby exposing the employee to electric shocks.

The employer shall use either ground fault circuit interrupters as specified inparagraph (b)(1)(ii) of this section or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section toprotect employees on construction sites. These requirements are in addition to any other requirements for equipment grounding conductors. On or about May 2, 2012 - at the above addressed jobsite, receptacles used as part of a temporary electrical system were not protected by ground fault circuit interrupters or an assured equipment grounding program, thereby exposing the employee to hazards associated with electrical shock. THE DISCOUNT PLUMBING INCORPORATED WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 1926.404(b)(1)(i), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 312752157, CITATION NUMBER 1, ITEM NUMBER 2 AND WAS AFFIRMED AS A FINAL ORDER ON JANUARY 22, 2009 WITH RESPECT TO A WORKPLACE LOCATED AT 7240 W. DEVON AVE, CHICAGO, IL 60618.
