29 CFR 1926.416(a)(1):     No employer shall permit an employee to work in such proximity to any part of an electric power circuit that the employee could contact the electric power circuit in the course of work, unless the employee is protected against electric shock by deenergizing the circuit and grounding it or by guarding it effectively by insulation or other means.    The employer is failing to protect employees from potential electrical hazards associated with operating and transporting off road construction equipment near high power electrical lines.  This was most recently evident during the inspection of the work site located 50 meters south of the intersection of Hwy 75 and LaPlatte Road, Bellevue, NE 68123, where the employer has an employee of his subcontractor exposed within 10 of an overhead power line while riding on the boom of a Caterpillar 245B excavator as it was hauled on a trailer down the road of a worksite.

29 CFR 1926.600(a)(6):     All equipment covered by this subpart did not comply with the requirements of 1926.550(a)(15) when working or being moved in the vicinity of power lines or energized transmitters:    The employer is failing to protect employees from potential electrical hazards associated with operating and transporting off road construction equipment near high power electrical lines.  This was most recently evident during the inspection of the work site located 50 meters south of the intersection of Hwy 75 and LaPlatte Road, Bellevue, NE 68123, where the employer has employees exposed 7500kv power lines while transporting a Caterpillar 245B excavator on a trailer behind a Mack CL 700 haul truck.  Instances include but are not limited to:    i. An employee of his subcontractor exposed within 10 of a 7,500kv overhead power line while riding on the boom of a Caterpillar 245B excavator as it was hauled on a trailer down the road of a worksite.       ii. An employee of his company operating the haul truck was exposed to potential electrical hazards when the cargo (a Caterpillar 245B excavator) he was hauling came within 10 of a 7,500kv overhead power line.
