OSH Act of 1970 Section 5(a)(1):    The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    On or about April 29, 2012, at the job site located 50 meters south of the intersection of Highway 75 and LaPlatte Road, Bellevue, NE 68123, the employer failed to protect employees from potential fall hazards associated with improper mounting, dismounting, and riding on off-road construction equipment when the employer had an employee mounting, climbing, and riding on the arm of a Caterpillar 246B excavator that was being hauled in transit on a semi-truck trailer.  The employee was positioned as high as 20 feet from the ground on the arm of the excavator for the purpose of observing clearance between the top of the arm and a low hanging power line without the benefit of hand and foot holds and was exposed to a fall in excess of 6 feet.  The excavators operators manual specifically prohibits a person from i) mounting the machine at any place without steps and/or handholds and ii) riding the machine unless seated and belted in.    Among other methods, feasible and acceptable means of hazard abatement include: prohibiting employees from mounting equipment except at places where steps and/or handholds are provided, prohibiting employees from climbing on moving equipment, prohibiting employees from riding on equipment except at places meant for riding, and implementing work rules and training that address the dangers of improperly mounting, climbing and riding on equipment.

29 CFR 1926.416(a)(1):     No employer shall permit an employee to work in such proximity to any part of an electric power circuit that the employee could contact the electric power circuit in the course of work, unless the employee is protected against electric shock by deenergizing the circuit and grounding it or by guarding it effectively by insulation or other means.    The employer is failing to protect employees from potential electrical hazards associated with operating and transporting off road construction equipment near high power electrical lines.  This was most recently evident during the inspection of the work site located 50 meters south of the intersection of Hwy 75 and LaPlatte Road, Bellevue, NE 68123, where the employer has an employee exposed within 10 of an overhead power line while riding on the boom of a Caterpillar 245B excavator as it was hauled on a trailer down the road of a worksite.

This was most recently evident during the inspection of the work site located 50 meters south of the intersection of Hwy 75 and LaPlatte Road, Bellevue, NE 68123, where the employer has an employee exposed within 10 of an overhead power line while riding on the boom of a Caterpillar 245B excavator as it was hauled on a trailer down the road of a worksite.
