29 CFR 1926.651(j)(2):  Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:      (a) On or about March 29, 2012, at a job site located at or near 13126 S. Hwy. 71 in Grandview, MO, an employee was exposed to possible "struck by" and/or trench collapse hazards while working in a trench where the excavated dirt (spoil pile) had been placed at the edge of the trench and not set back 2 feet (.61m) as required.

29 CFR 1926.1053(b)(1):  Where portable ladders were used for access to an upper landing surface the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:        (a) On or about March 29, 2012, at a job site located at or near 13126 S. 71 Hwy. in Grandview, MO, an employee was exposed to possible fall and/or trench entrapment hazards in that his only access in and out of the trench was a collapsed A-frame type step ladder that was approximately 1 foot short of reaching the upper landing surface (i.e., the top of the trench).  At the time of the inspection the ladder was leaning against the east wall of the trench, near the north end.

Hwy. 71 in Grandview, MO, an employee was observed to be working in a trench with his sole means of egress being an A-frame type step ladder that was in its collapsed position and had been leaned against the east trench wall.

29 CFR 1926.652(a)(1):  Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the sloping and benching provisions of 29 CFR 1926.652(b)(1); (b)(2); or (b)(3):      (a) On or about March 29, 2012, at a job site located at or near 13126 S. Hwy. 71 in Grandview, MO, an employee was exposed to possible trench collapse hazards in that he was working in a trench greater than 5 feet in depth which was not adequately sloped or benched.  No alternative form of cave-in protection (e.g., bracing, shoring, trench box, etc.) was in place or in use at the time of the inspection.      Howco Utilities, LLC, was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 314466871, citation number 01, item number 001, and was affirmed as a final order on December 5, 2010, with respect to a workplace located at Cherry St. and E. 18th St. in Kansas City, MO.
