29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. A) West end of building 8, on or about May 2, 2012, a wooden platform/basket attached to the front of a GEHL forklift used to lift an employee in the air, did not have guardrails across the front, exposing the employee to a fall hazard of approximately 25 feet. ABATEMENT CERTIFICATION IS REQUIRED.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. A) Roof of building 8, on or about May 2, 2012, employees were performing roofing work, such as removing and installing shingles without using fall protection, exposing employees to a fall hazard of between 30 and 40 feet. ABATEMENT CERTIFICATION AND DOCUMENTATION ARE REQUIRED.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: A) Front of building 8, on or about May 2, 2012, employees were using a metal extension ladder to access the roof of a residential type building. The ladder did not extend three feet above the roof, exposing employees to a 30 foot fall hazard. ABATEMENT CERTIFICATION AND DOCUMENTATION ARE REQUIRED.
