OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment that were free from recognized hazards and were causing, or likely to cause, death or serious physical harm to employees in that employees were exposed to crushing hazards associated from falling objects: On or about May 4, 2012, steel storage racks located in the warehouse were not installed and maintained as to prevent damage or collapse of the racks. Deficiencies included, but were not limited to, a) bottom portion bracing of the racks had visible damage in the warehouse area and cooler area; b) storage rack base plates were not anchored to the floor in the warehouse area and cooler area. Among other methods, feasible and acceptable methods to correct the hazard are implementation of the requirements found in ANSI MH16.1: 2008 which include: Section 1.4.9: Upon any visible damage, the pertinent portions of the rack shall be unloaded immediately by the user until the damaged portion is repaired or replaced, and Section 1.4.7: All rack columns shall be anchored to the floor with anchor bolts capable of resisting the forces caused by the horizontal and vertical loads on the rack.
