OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees    Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards related to working from an elevated platform:    (a)  Superior Construction located at 420 Charmony Frontage Road in Sterling, CO 80751:  On and before May 1, 2012, employees were exposed the hazard of falling approximately 16 feet to ground below while working from an elevated metal platform 20 feet in width.  The platform was raised by a Sky Trak 6036 all-terrain forklift.  The width of the platform exceeded ANSI/ITSDF B56.6-2011 design specifications.  Among other methods, one feasible and acceptable abatement method to correct this hazard while using an all-terrain forklift for lifting personnel is to follow the requirements set forth in ANSI/ITSDF B56.6-2011.

29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:    (a)  Superior Construction  located at 420 Charmony Frontage Road in Sterling, CO 80751:  On and before May 1, 2012, an employee was removing sheet metal roofing material with a Genie Z 34/22 aerial lift and was not wearing fall protection.  This hazard exposed the employee to a fall of approximately 16 feet.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels and 50-feet (15.25 m) wide or less, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, warning line system and personal fall arrest system, or warning line system and safety monitoring system, or by the use of a safety monitoring system alone:    (a)	Superior Construction located at 420 Charmony Frontage Road in Sterling, CO 80751:  On and before May 1, 2012 the employer did not ensure their employees were protected from injury, in that employees engaged in roofing activities on a low sloped roof of an industrial building were exposed to falls of approximately 16 feet without the use of an adequate fall protection system.

29 CFR 1910.178(l)(6):  The employer did not certify that each operator has been trained and evaluated in the safe operation of the forklifts in the workplace     (a)	Superior Construction located at 420 Charmony Frontage Road in Sterling, CO 80751:  On and before May 1, 2012, the employer did not certify that the forklift operator had been trained and evaluated as required by 29 CFR 1910.178(l) in the topics as outlined in 29 CFR 1910.178(l)(3).      Abatement Note:  The certification shall include:          (1)  The name of the operator;        (2)  The date of the training;        (3)  The date of the evaluation; and,        (4)  The identity of the person(s) performing the training and evaluation.
