29 CFR 1926.452(j)(3):     When guardrails were used for fall protections, a workbench meeting the requirements was not in use.    a)  Lincoln Avenue & 1st Avenue, Avon, NJ:  Employees were utilizing pump jack scaffold that was not fully guarded with netting to protect the employees from falls from the pump jack scaffold in all areas of work.  The employees were working at a height of 14 feet above the ground level, observed on or about 5/2/12.    NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(g)(1):     Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:    a)  Lincoln Avenue & 1st Avenue, Avon, NJ:  Employees were preforming siding installation and were exposed to fall hazards due to improper guarding of the pump jack scaffold.  The height from the ground level to the working surface was greater then 14 feet from the ground level, observed on or about 5/2/12.      NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.     AMARAL SIDING, INC.; WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD, ITS EQUIVALENT, OR ESSENTIALLY SIMILAR STANDAR, 1926.451(g)(1) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 315153403 CITATION NUMBER 01, ITEM NUMBER 04, ISSUED ON 2/15/11.
