OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were working on the shoulder, near the traveled way I-39 Mile Post 70.0 to Mile Post 67.5 southbound without providing advance warning to approaching road users of the presence of workers.    On May 21, 2012, Stantec Consulting Services Inc., employees worked on the shoulder, near the traveled way of I-39 from approximately Mile Post 70.0 to Mile Post 67.5 Southbound without warning approaching road users of the presence of workers.  Among other methods, feasible and acceptable abatement methods to correct the hazard include, but are not limited to the following:
